Recycling Common Electronic Gadgets

Modern life is full of electronic gadgets. Cell phones, digital cameras, camcorders, MP3 players, computers, laptops, monitors and more are common in all modern households. These modern electronic devices provide entertainment and help us in many ways. The problem with them is that they wear out or become obsolete, and then we are faced with the challenge of how to dispose of them.

Simply throwing electronic devices in the trash may be 1 option, but it is an option with a significant environmental impact. According to the US Environmental Protection Agency (EPA), over 200 million tons of electronic waste (e-waste) ends up in landfills every year. The problem with this is that many consumer electronic items contain harmful materials such as lead, mercury, arsenic, cadmium and more. These materials can pollute the land, water, and air. In fact, according to Earth 911, over 70% of toxic waste found in landfills comes from e-waste.

Some items, such as computers and computer monitors, are banned from landfills and curbside trash pickup. In some states and municipalities, it is illegal to simply throw away such items. So the challenge is twofold, how to dispose of properly to comply with applicable laws, or how to dispose of properly because it is the environmentally responsible thing to do.

Most people are familiar with the recycling of cans, glass, paper, and plastic. They either take it to designated recycling centers at their landfill, or transfer station, or they are picked up through curbside recycling efforts. When it comes to recycling our electronic gadgets, the task becomes significantly more difficult. Unlike cans, paper, plastic, and glass, there is typically not curbside recycling for electronic devices. You also typically cannot simply take such items and leave them at the landfill or transfer station. Thus, recycling our gadgets requires some thought and effort. It is important to know your recycling options for common electronic items.

Reuse Electronic Devices through Donation

An excellent option for electronic gadgets that are still in working order is to donate them to someone who can make use of them. Many schools and community groups are happy to receive working electronic items. Schools, for example, often are very appreciative to receive donated computers, peripherals, and monitors. There are even tax incentives built into the Taxpayer Relief Act of 1997 for companies to donate such items to schools. Cell phones are another item that many community organizations love to receive in donation. In addition, there are national organizations that will accept donations of electronic items. Recycling Unwanted Electronic Gadgets

If reuse through donation is not an option there are numerous programs for recycling unwanted electronic items. Many municipalities will have special days at their landfill or transfer station where these items will be accepted for recycling. There may be a fee associated with these programs.

In addition, many major manufacturers of common electronic items will accept them for recycling, including Acer, Apple, Dell, Epson, Gateway, Hewlett-Packard, Lenovo/IBM, Panasonic, Sony, and Toshiba. Many major retailers also have recycling programs, including Best Buy, Circuit City, Office Depot, and Staples.

For cellular phones, many cell phone manufacturers, and all of the major wireless companies provide recycling programs for cell phones. Most of the programs will accept anyone’s cell phones for recycling.

A Word About Recycling Batteries

General purpose and alkaline batteries are not considered to be hazardous waste by the US Government. These items may be disposed of with normal household waste except in California where non-households must dispose of them in accordance with the California Universal Waste Rules. Recycling programs for general purpose and alkaline batteries are rare.

HAWAII EMPLOYMENT LAW AND LITIGATION BASICS: HOW DO I DRAFT A LITIGATION HOLD POLICY AND IMPLEMENT A PLAN FOR ELECTRONIC DISCOVERY?

 

Electronic evidence is quickly evolving into one of the most difficult areas of litigation to navigate.  Hawaii businesses, especially human resource managers in employment disputes, must understand that it is extremely important to work closely with counsel to determine the extent of their discovery obligations.  Once the preservation requirement arises, Hawaii businesses must map out a sensible data gathering plan to minimize business disruptions and to avoid possible sanctions.

1.       Ensure the Company Buys Into What is Needed to Comply With the New Discovery Rules and Allocate Sufficient Resources.

Convince other managers/decisionmakers to make retention policies/electronic discovery planning a key initiative.  Those employees need to understand and appreciate the risks of court-ordered sanctions for the improper destruction of documents or electronically stored information.

2.       Understand Basic Retention/Hold Issues.

Understand that a litigation hold is required when: (1) The Company receives a demand to preserve the record(s); (2) the Company is aware that a lawsuit or administrative action has been filed; (3) the Company receives a preservation order from the Court, OR; (4) litigation is reasonably foreseeable.  Understand that a record is stale and therefore subject to destruction where the record no longer has any operational, business or legal value to the Company, any applicable retention period(s) has expired AND the record is not subject to a litigation hold.

3.       Draft and Review Policies on a Regular Basis.

Draft appropriate policies, such as retention and computer usage policies, and communicate with and train employees on them.

Understand that a retention policy should limit how long information is kept and that “business related” documents generally should be retained at least for the amount of time established by statute.  A document is “business related” when it documents a specific business related event or activity, it demonstrates a specific business transaction, supports facts of a particular business related event, activity or transaction, or it relates to specific legal, accounting, business or compliance issues.

4.       Have a Plan to Preserve Documents.

Understand when preservation obligations are triggered and work with your IT department, Administrative and Executive personnel to formulate a plan. The goal should be to incorporate necessary retention requirements with organizational needs to establish not only a retention policy, but also a policy regarding the manner in which documents will be stored or organized when the hold arises.

Ideally, the Company should have a response team in place when preservation obligations are triggered comprised of individuals from various departments within the organization such as Human Resources, Information and Technology and Administrative.

Fed. R. Civ. P. 26(a)(1)(B) and 26(f)(3) now require parties early on in a case to disclose the category and location of electronically stored information and the forms in which they would be produced as part of the mandatory disclosure process.  Accordingly, it is important to be prepared early on in a case to specifically discuss with your attorney preservation issues, network systems, procedures, storage, and locations of potentially relevant electronically stored information.

5.       Understand that “Electronic Evidence” May Reside Not Only on Computers, But on Other Electronic Devices.

Information Technology (“IT”) professionals need to understand more than the technical side of computer network and Human Resource managers need to know more about the technical side of the computers/devices used by employees. IT should be able to help you determine to what extent “Instant messaging,” home computers, laptops, PDA’s, flashdrives, floppy disks, CD ROM’s, voice mail and similar devices both retain and communicate electronic/digital information.

On the other hand, understand that the IT department might not be aware of every server, hard drive, and file location and the impact the discovery rules may have on IT-driven policies/procedures.

 6.       Have a Response Team Prepared at all Times.

A response team should be comprised of individuals from various departments within the organization.  The team should also communicate early and often with legal counsel.

7.       Educate/Train Employees on the Importance of E mail.

Electronic mail essentially launched litigation into unknown territory that many employers have still not addressed with policies and/or training.  One of the best steps you can take is to educate and train your employees on the potential that e-mail will be the “smoking gun” or at the very least used against them. 

Employees think that when they delete an e-mail from their computers, it is gone and erased for good.  Of course, that is an incorrect assumption.  Employees need to understand that e-mail is not private, and that the employer reserves the right to inspect and view employees’ e-mail and on-line activities at work.

8.       Understand the Impact Metadata will have on the Production Process.

Fed. Rule Civ. P. 34(b) permits the requesting party to specify the production format for electronic documents. When the production format isn’t specified or if the responding party objects to the requested format, the responding party must state how the information will be produced.  The default production format may be a form (or forms) in which the information is “ordinarily maintained” or in a “reasonably usable” form. 

The federal discovery rule changes may not promote self-regulation.  Courts will likely get involved very quickly in discovery disputes involving electronically stored information.  The issue whether the producing party must allow metadata to be viewed by the requesting party may have to be decided by the Court since the issue is relatively unchartered area.

The Value of Electronic Statement Presentment

Electronic Statement Presentment has been around for a number of years now and many companies have employed Electronic Statement Presentment technology with success.

 

For some consumers, the provision of statements electronically is highly desirable. It means that they can manage their financial relationship with your company easily whether in a hotel the other side of the world at home.

 

It also provides an additional vehicle for a company to market to their consumers. Just as we would use transpromo techniques on a traditional paper based statement, we can apply the same theory and logic to Electronic Statement Presentment.

 

So in the classic model, how does Electronic Statement Presentment work?

 

Electronic Statement presentment can be implemented and delivered most quickly and easily through the implementation of an electronic archive an retrieval (more latterly these are becoming known as ‘Vaults’) system. There are other ways of doing this but, they are complex to implement and perhaps have a greater value for B2B rather than B2C markets.

 

So, in this article I am not going to talk about high end Electronic Bill Presentment & Payment (EBPP), the payment side of this is a topic worthy of at least a few articles!

 

The Document Archive and Retrieval system will typically reside within the remit of the document production management team. In order to generate the electronic statement, the first stage is exactly the same as for the production of a paper based document.

 

The Document Composition engine is thus the first stage of the process. In fact, it is likely that Electronic Statements will be generated as part of the same job. The difference is a switch flag within the data file that tells the composition engine whether the bill is for Electronic Presentment or not – many companies will choose to ingest every generated document into the Vault -, if not to enable consumer access but to enable call centre and customer service access to customer statements and documents. But more on this another time.

 

In its simplest form (we’ll avoid talking about XML generated data for online presentment at this stage) the document composition engine generates a print stream. Once generated, this print stream can then be ingested into the Vault.  As the print stream is ingested, each customer statement is indexed by core characteristics – account number, name etc- and then utilising some clever compression algorithms is reduced in size and then stored in the vault.

 

For most Vault type systems, the compression algorithms are highly effective these days and can massively reduce the size of ingested print streams.

 

Most Vault systems have an API facility. This means that software such as that that drives your companies website can access the Vault. By communicating through the API, serach and retrieve requests can be made by virtually any business application.

 

Once the search is complete, an individuals document can be made available online. To the user, the visibility of the document looks just like your website and is seamless from a user perspective. The document is secure because it is the website that is managing access to the vault – so only documents relevant to an individual user can be seen.

 

Good document archive and retrieval software will provide the user with additional functionality – such as the ability to generate a report from the document. They can search for frequency of use of certain phone numbers, spends within a particular restaurant and so on.

 

Where customers can be persuaded to switch off paper based statements and to start using electronic statements, the savings for the company can be significant. The cost of physical mail is high whereas the cost of electonic presentment is very low. Some companies choose to offer incentives to encourage companies to move towards a paper billing process.

 

But perhaps the real value of the Electronic Statement is the way in which it draws you customer to your website. It encourages an ongoing dialogue. There is a necessity now for the customer to visit your website and this provides the opportunity to market to the customer more, perhaps encourage the customer to take a short survey or purchase more from your company.

 

It is perhaps not a good idea to email statements to a customer, this is essentially insecure and, it is not likely to draw the customer back to your website. However, an email with a link to a specially designed one – one log in landing page for that customer presents an exciting opportunity for customer engagement.

 

Electronic Statement Presentment will provide a host of operational benefts not least s the operational flexibility that the automated document factory will get and, the reduction in call periods within the call centre -because the statements are held electronically, they can be viewed in the call centre exactly as the customer sees them which speeds up problem resolution.

 

Most vendors have some kind of Vault system, some with some very powerful features. But this really is the easy way to get documents online and available to customers.

 

These systems can literally be up and running within a matter of days, they are low risk projects that reduce costs and enhance the service that you can deliver to your companies customers.

Russian English Electronic Translators

Electronic translators that translate from Russian to English and back again are one of the best gift ideas you can come up with. Don’t go so cheap you regret it. If the electronic translator is extremely limited in what it can do to make it virtually worthless, you might as well leave it at home.

Look it as a tool to leverage your ability to communicate. You are spending a lot of money to travel over there. Make the most of your trip.

On the other hand, you don’t need the ability to translate a complete medical or technical vocabulary unless you are planning on performing a medical operation on the women you are visiting, or teaching them nuclear physics.
